Is establishing guardianship free of charge?

Yes, the state service for establishing guardianship or sponsorship is provided completely free of charge (Clause 85 of the Resolution).

What is preliminary (temporary) guardianship?

In cases of danger to the child’s life or emergencies, the child can be placed with a temporary guardian within one working day before all documents are gathered (Appendix 4).

Is the child’s opinion considered when establishing guardianship?

Yes, the consent of a child who has reached the age of 10 is mandatory when appointing a guardian or sponsor.

Who can be a guardian or sponsor?

Only adult, legally capable individuals in good health and with no criminal record. Priority is given to the child’s close relatives (Appendix 1, Clause 6).

Who makes the decision on appointing a guardian/sponsor?

As of February 1, 2025, all decisions are made by district (city) “Inson” social services centers (the authority of Hokimiyats has been abolished).

What is the difference between guardianship and sponsorship?

Guardianship (vasiylik) is established for children under 14, while sponsorship (homiylik) is for minors aged 14 to 18.

What is the timeframe for establishing guardianship or sponsorship?

From the date it is determined that a child is deprived of parental care, the issue of appointing a guardian is reviewed within a maximum of one month (in urgent cases, preliminary guardianship is handled in 3 days).
